Important Update on Rentals

A Court Order temporarily suspended that part of the DOS Guidance that restricted landlord’s brokers from collecting a commission from the tenant.

This means that until further notice landlord’s brokers can continue to collect a commission from the tenant without fear of sanction by the DOS.

The Court Order was the result of a lawsuit initiated by NYSAR, REBNY, and others.  The parties to this lawsuit are due back in court on March 13, 2020 to continue to argue the DOS’s interpretation of the Housing Stability and Tenant Protection Act of 2019.
